Privacy Policy

This privacy policy (“Privacy Policy”) explains how we collect, use and disclose the personal information you provide when you register at skydeck.com (this “Site”).

Effective December 3, 2009

1. Updates and Changes

We may update this Privacy Policy from time to time as our Site and Services evolve. We will notify you of any changes when you login to Skydeck. We believe that you should not have the burden of re-reading the entire policy every few weeks in case it has changed.

2. Your Data

To do what Skydeck does, we need you to trust us with a lot of information, including your contacts, text messages, and call history. We call these records and information “Your Data.” When it comes to Your Data, Skydeck operates on four simple principles:

It’s Your Data.

Your Data belongs to you. It doesn’t belong to your cell phone company and it doesn’t belong to Skydeck.

You can come and go as you please.

You can export Your Data from Skydeck at any time. You can take it to one of our competitors if you wish and delete your Skydeck account at any time.

You control what data you share.

Some features of Skydeck are based on sharing data with other members, but you can always opt out or turn these features off. You are only required to share your name.

Skydeck employees have no access to Your Data unless you explicitly request customer support for a problem related to your account, and then only to the extent necessary to solve your problem.

We may display advertising on our site, but we will never share Your Data with advertisers or with third parties that display advertising on our behalf.

We won’t change anything without telling you.

While we’ve said it before, it bears repeating. You don’t have to check back frequently to see if our privacy policy has changed. If we change it, we will notify you at login. And because you can export and delete Your Data at any time, you will always have a choice.

3. Information — What We Collect and How We Use It

We collect information to provide and improve our Site, Content and Services and to administer your membership — all of which we refer to as “Skydeck Products.”

What we collect in addition to Your Data.

When you register with us, some of what we’ll ask you for is considered “Personal Identifying Information.” This refers to information about you that can be used to contact or identify you. Such information typically includes your name, phone number, email address and home and business postal addresses. While some Personal Identifying Information is required to join Skydeck, you have the option to provide additional Personal Identifying Information in your Skydeck Profile (“Profile.”)

We also ask for other information, such as your zip code and personal preferences, which is typically considered “Non-Identifying Information” since it can’t be used to identify you on its own. Sometimes Non-Identifying Information can be considered part of your Personal Information if it is combined in such a way that it enables you to be identified (for example, combining your zip code with your street address).

How we use it.

We use your Personal Identifying Information (in some cases with your Non-Identifying Information) and Your Data mainly to provide the Skydeck Products and respond to your inquiries.

We may also use your Personal Identifying Information with your Non-Identifying Information and combine it internally with information collected from other Skydeck members so as to provide you with a better experience; improve the Skydeck Products and understand how they are used; and serve you specifically, for instance to send you administrative notices or to deliver a product to you according to your individual preferences or restrictions.

We also use your Personal Identifying Information to contact you with Skydeck newsletters, marketing or promotional materials and other information that may be of interest to you. You can unsubscribe from these communications at any time by following the unsubscribe instructions provided in any of the communications or updating your ‘email preferences’ information on the Site under ‘My Account.’

Except as explained in Section 4, we never disclose your Personal Identifying Information to anyone without your permission.

Technical Data. When you visit the Site, whether you’re a member or just browsing, our servers automatically record certain information that your browser transmits so that we may keep track of which Skydeck Products you access. We do this in order to ensure that Skydeck Products are available to you and customized for your use. During this process we may also collect your IP address and browser details, as well as store cookies in your browser, all of which help us personalize and improve the Skydeck Products. While you have the option to stop your browser from accepting Skydeck cookies at any time, this may limit the functionality of the Skydeck Products. For more information on how to stop accepting cookies, please refer to the help menu for your web browser.

Additional Phones. Skydeck is for use only with cell phone accounts that you own and control. We may send a security code to your cell phone by text message to confirm that you own any phone you use with Skydeck. On a multi-line plan, we do not display the details of calls on any lines for which we have not received security code confirmation. Please make sure that other users on your cell phone account have read and understood this privacy policy.

4. Information Sharing and Disclosure

Everyone

Anyone can see the Personally Identifying Information on your Profile that is marked ‘public.’

All Skydeck Members

If a Skydeck member has your contact information in their address book, or you call them without blocking your phone number, we will indicate to them that you are a Skydeck member and display the public information from your Profile.

If you opt in to Skydeck Caller ID, Skydeck will use the information in your address book, in addition to other sources, to verify Caller ID results for other Skydeck members. If you prefer not to allow Skydeck to use the information in your address book in this manner or you do not have the permission of your contacts as required by the Skydeck Terms of Service, do not opt in to Skydeck Caller ID.

Skydeck Connections

If you add a new Connection to your network, we will share all the Personally Identifying Information in your Skydeck Profile with that Connection in accordance with the settings on your Profile and under ‘My Account.’

Except as otherwise stated in this Privacy Policy, Skydeck will not rent, sell or share Your Data.

Aggregate Information and Non-Identifying Information. We combine Your Data and the data of many other users into anonymous sets of “aggregated information.” All Personal Identifying Information is stripped out and all cell phone records are replaced with random numbers. We share this aggregated information, Non-Identifying Information, and log data with third parties for analysis so that we can continuously improve the service. We will not, however, share your Personal Identifying Information for these purposes.

Service Providers. We may employ third party service providers to assist us in administering and providing the Skydeck Products. However, service providers never have access to Your Data in non-encrypted form except for information that they need to perform a specific task on our behalf. For example, a company managing our email list will have access to your email address if you receive email from Skydeck. Such service providers are obligated not to disclose or use the data for any other purpose. With your explicit prior permission in each case, we also provide outside technology developers who have registered with Skydeck access to Your Data so that they can deliver products and services that you request, which may be used to enhance your use of the Skydeck Products.

Compliance with Laws and Law Enforcement. Skydeck discloses information about you to government or law enforcement officials or private parties as appropriate to respond to legal process (court orders, subpoenas, etc).

Business Transfers. Skydeck may sell, transfer or otherwise share some or all of its assets, including the systems that store Your Data, in connection with a merger, acquisition, reorganization or sale of assets, or in the event of bankruptcy. If any of these events occur, we’ll notify you so that you have an opportunity to delete Your Data.

5. Changing or Deleting Your Information

You may review, update, correct or delete Your Data on the Site. If you completely delete all Your Data, then your account will be deactivated. To delete your account, go to ‘Delete Account’ under ‘My Account’ in Skydeck. Skydeck backs up data nightly for your protection, so it may take up to 30 days for all trace of Your Data to be erased from our systems.

6. Security

Skydeck is very concerned with safeguarding your information. We employ administrative, physical and electronic measures designed to protect your information from unauthorized access.

7. International Transfer

Your information may be transferred to — and maintained on — computers located outside of your state, province, country or other jurisdiction where the privacy laws may not be as protective as those in your area. If you are located outside the United States and you choose to provide Your Data to us, Skydeck will transfer it to the United States and process it there. By consenting to our Privacy Policy, and submitting information, you agree to that transfer.

8. Links to Other Sites

Our Site contains links to other websites. While we do our best to link to reputable sites, the fact that we link to a website or present an ad is not an endorsement, authorization or representation of our affiliation with that third party. We do not exercise control over third party websites and we encourage you to read the privacy policies or statements of other websites that you visit.

9. Our Policy Toward Children

We do not knowingly collect personal identifying information from children under 18. If a parent or guardian becomes aware that his or her child has provided us with such information without the Parent’s or Guardian’s consent, he or she should contact us at privacy@skydeck.com. If we become aware that a child under 18 has provided us with personal information, we will delete such information from our files.

10. Phishing

Skydeck is concerned about identity theft and the practice currently known as “phishing.” We treat safeguarding Your Data as a top priority. We do not and will not, at any time, request your credit card information, your account ID, login password, or national identification numbers in a non-secure or unsolicited email or telephone communication.
